Terms & Conditions

The rules for using Elate QR — written to be read, not skimmed past. The short version: use the Service honestly, own what you publish, and we'll keep the platform running for you.

01Agreement to these terms

These Terms & Conditions (the “Terms”) govern your access to and use of Elate QR — our website, applications, QR codes, landing pages, and related services (together, the “Service”). By creating an account or using the Service, you agree to be bound by these Terms and by our Privacy Policy.

If you use the Service on behalf of an organization, you represent that you have authority to bind that organization, and “you” refers to the organization.

02The Service

Elate QR lets you create and manage QR codes — including dynamic QR codes whose destination can be changed after printing — along with digital business cards (vCards), hosted landing pages, and privacy-preserving scan analytics. Features vary by plan, and we may add, change, or retire features as the Service evolves.

03Accounts and workspaces

You need an account to use the Service. You are responsible for the accuracy of your account information, for keeping your credentials confidential, and for all activity that occurs under your account. Notify us promptly at [email protected] if you suspect unauthorized access.

Content in the Service belongs to a workspace (organization). Members you invite to a workspace can view and, depending on their role, manage its QR codes, landing pages, and analytics. You are responsible for who you invite and the roles you grant.

04Your content

You retain ownership of everything you upload or configure in the Service — destination URLs, landing page content, contact details, logos, and imagery (“Your Content”). You grant us a limited, worldwide, non-exclusive license to host, store, reproduce, and display Your Content solely to operate the Service — for example, serving your landing page to someone who scans your code.

You are solely responsible for Your Content, including having the rights to use it and ensuring that the destinations your QR codes point to are lawful and accurately represented.

05Acceptable use

You agree not to use the Service to:

  • direct people to phishing, malware, or otherwise deceptive or harmful destinations, or misrepresent where a QR code leads;
  • distribute content that is illegal, infringing, or that violates the rights or privacy of others;
  • send spam or engage in unsolicited mass outreach;
  • probe, disrupt, or circumvent the Service’s security, rate limits, or plan quotas;
  • resell or white-label the Service without our written permission.

We may suspend or disable QR codes, landing pages, or accounts that we reasonably believe violate these rules. Where practical, we will notify you and give you a chance to remedy the issue.

06Plans, billing, and cancellation

The Service offers a free plan and paid subscriptions billed monthly or annually. Payments are processed by Stripe; we do not store your card details. Prices are listed before you subscribe and exclude any applicable taxes.

  • Subscriptions renew automatically at the end of each billing period until cancelled.
  • You can upgrade, downgrade, or cancel at any time from your workspace’s billing settings. Cancellation takes effect at the end of the current billing period; we do not provide refunds for partial periods except where required by law.
  • Each plan includes usage limits (such as the number of dynamic QR codes or team seats). If you exceed them, we may ask you to upgrade or restrict the creation of new resources — existing QR codes keep working.
  • If a payment fails and remains unpaid after reasonable notice, we may downgrade the workspace to the free plan.

07Scan data and analytics

The Service records privacy-preserving telemetry when your QR codes are scanned, as described in our Privacy Policy. Where you collect personal data from visitors through your landing pages or destinations, you act as the data controller for that data and are responsible for complying with applicable privacy laws, including providing any required notices and obtaining any required consents.

08Availability and changes to the Service

We work to keep the Service fast and reliable, but it is provided without a guaranteed uptime commitment. We may modify the Service, and we will give reasonable notice before discontinuing a material feature you rely on. Scheduled maintenance and factors outside our control (including outages of third-party providers) may occasionally interrupt availability.

09Intellectual property

The Service — including its software, design, and branding — is owned by us or our licensors and is protected by intellectual property laws. These Terms do not grant you any rights to our trademarks or branding. QR codes you generate for your own destinations are yours to print and distribute.

If you send us feedback or suggestions, you grant us the right to use them without restriction or compensation.

10Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you materially breach these Terms, if required by law, or if we discontinue the Service (with reasonable advance notice in that case).

When a workspace is deleted, its QR codes stop resolving and its content and analytics are deleted or scheduled for deletion. Export anything you need before deleting your account — dynamic QR codes that are already printed will no longer work once they are gone.

11Disclaimers

The Service is provided “as is” and “as available”. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that scan analytics will be complete or accurate in every case.

12Limitation of liability

To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or goodwill, arising from or related to your use of the Service. Our total liability for all claims in any twelve-month period will not exceed the amounts you paid us for the Service in that period (or USD 50 if you have paid nothing). Nothing in these Terms limits liability that cannot be limited by law.

13Changes to these Terms

We may update these Terms from time to time. If a change is material, we will notify you — for example by email or an in-app notice — before it takes effect. Continuing to use the Service after a change takes effect means you accept the updated Terms; if you do not agree, stop using the Service and delete your account.

14Governing law

These Terms are governed by the laws of the jurisdiction in which the operator of Elate QR is established, without regard to conflict of law rules, and disputes will be resolved in the courts of that jurisdiction — except where the law of your country of residence grants you mandatory consumer protections and venue.
